If your income is less than your monthly expenses, and you have thousands of dollars in debt, you may need a fresh start. If you qualify, a Chapter 7 bankruptcy may provide you that fresh start. If you meet the regulatory requirements and are willing to put in the time and effort needed to provide the required disclosure, within 90 days after your filing date, you may have a total discharge of your dischargeable debt. For most clients, that is almost all the debt they have – except for student debt and tax debt – and there are even circumstances where, if you have filed your taxes and several years have elapsed without a tax lien – even tax debt may be discharged.
It is a complicated area. The government will forgive a great deal of debt as long as you do not break the rules.
